Terms and Conditions

Welcome to TTKom.

These Terms and Conditions (“Terms”) govern your access to and use of TTKom’s internet connectivity, hotspot services, customer portal, website, telecommunications services, equipment, and any other services provided by TTKom (“Services”).

By registering for, purchasing, accessing, or using any TTKom Service, you agree to be bound by these Terms. If you do not agree with these Terms, you should not use or subscribe to TTKom’s Services.

For purposes of these Terms, “TTKom,” “we,” “us,” or “our” refers to TTKom, while “customer,” “you,” or “your” refers to the person or organization subscribing to or using our Services.

These Terms shall be interpreted in accordance with the applicable laws and regulations of the Republic of Malawi.


1. Eligibility and Account Registration

To subscribe to TTKom Services, you must provide accurate and complete information required for registration and service provision.

2. Internet Services

TTKom provides internet connectivity and related services according to the package, subscription, plan, or service purchased by the customer.

Service speeds, data allowances, usage limits, fair-use policies, availability, and other service characteristics may vary depending on the customer's selected package.

Advertised speeds represent the applicable service capacity or maximum achievable speed under suitable network conditions and may be affected by factors including:

TTKom does not guarantee uninterrupted or error-free access to the internet.


3. Acceptable Use

You agree to use TTKom Services responsibly and in compliance with applicable laws.

You must not use TTKom Services to:

TTKom may investigate suspected violations and take appropriate action, including restricting, suspending, or terminating Services where permitted by law.


4. Customer Equipment

Customers may be required to provide or use compatible equipment such as routers, computers, phones, access points, modems, or other network devices.

Customers are responsible for maintaining their own equipment unless the equipment has been supplied or is maintained by TTKom under a separate arrangement.

TTKom may provide technical specifications or configuration requirements to ensure compatibility with its network.

Customers must not intentionally modify, tamper with, bypass, or interfere with TTKom-owned equipment or network infrastructure.


5. TTKom Equipment

Where TTKom provides equipment to a customer, ownership of that equipment remains with TTKom unless otherwise agreed in writing.

Customers may be responsible for the reasonable cost of repairing or replacing equipment that is lost, deliberately damaged, or damaged through misuse, subject to applicable law and the terms of the customer's service agreement.


6. Fees and Payments

Customers are responsible for paying all applicable subscription fees, installation charges, equipment charges, usage charges, and other fees associated with their selected Services.

Payment through a third-party payment provider may be subject to that provider's terms and conditions.

TTKom will not be responsible for delays caused by payment providers, banks, mobile money platforms, or other third-party payment systems.


7. Service Suspension

TTKom may temporarily restrict or suspend Services where reasonably necessary, including where:

8. Network Maintenance and Service Interruptions

TTKom may occasionally interrupt Services to perform:

TTKom is not responsible for interruptions caused by circumstances outside its reasonable control, including failures of third-party infrastructure, power outages, natural disasters, civil disturbances, regulatory actions, or other force majeure events.

To maintain the stability, security, and performance of its network, TTKom may implement reasonable network-management measures.

10. Customer Responsibilities

TTKom is not responsible for security vulnerabilities in customer-owned devices, applications, operating systems, routers, or other equipment.


11. Internet Content and Third-Party Services

TTKom provides connectivity to the internet but does not control the content, products, services, websites, applications, or communications available through third-party networks.

TTKom is therefore not responsible for:

12. Customer Privacy

TTKom's collection and processing of personal and network information is governed by its Privacy Policy.

By using TTKom Services, customers acknowledge that certain information may need to be collected and processed to provide, secure, administer, troubleshoot, and bill for the Services.

TTKom may also process information where required or permitted by applicable law.


13. Network Monitoring and Security

TTKom may monitor and record technical information relating to its network for legitimate operational and security purposes.

This may include connection information, authentication records, IP addresses, device identifiers, timestamps, bandwidth usage, and other technical information.

Such information may be used to:

14. Intellectual Property

Unless otherwise stated, TTKom and its licensors retain all applicable intellectual property rights in TTKom's:

Nothing in these Terms transfers ownership of TTKom's intellectual property to a customer.


15. Website and Customer Portal

Information provided through TTKom's website, customer portal, or other online platforms is provided for general information and service-management purposes.

TTKom makes reasonable efforts to keep information accurate and current but does not guarantee that all website content will always be complete, accurate, or available.

TTKom may modify, update, suspend, or discontinue any website or portal functionality without prior notice where reasonably necessary.


16. Third-Party Links

TTKom's website or customer portal may contain links to third-party websites or services.

Such links are provided for convenience and do not necessarily constitute an endorsement or guarantee by TTKom.

TTKom is not responsible for the content, availability, security, or privacy practices of third-party websites.


17. Prohibited Resale and Sharing

Unless expressly authorized by TTKom, customers may not:

Business, public hotspot, reseller, or other commercial arrangements may be subject to separate agreements and pricing.


18. Termination

Either TTKom or the customer may terminate a service in accordance with the applicable subscription agreement or service terms.

TTKom may terminate or restrict Services where permitted by law if a customer:

Upon termination, outstanding amounts owed to TTKom remain payable.

Any TTKom-owned equipment must be returned in accordance with the applicable equipment terms.


19. Refunds

Refunds, credits, or adjustments will be handled in accordance with the customer's applicable service plan, payment terms, and TTKom's refund policy.

Where a payment has already been processed through a third-party payment provider, the applicable processing procedures may also apply.

TTKom may require proof of payment or transaction details when processing a refund or billing dispute.


20. Limitation of Liability

To the maximum extent permitted by applicable law, TTKom shall not be liable for indirect, incidental, special, consequential, or unforeseeable losses arising from the use or inability to use the Services.

21. Indemnification

To the extent permitted by law, you agree to indemnify and hold TTKom, its officers, employees, contractors, and authorized representatives harmless from claims, losses, damages, liabilities, and reasonable expenses arising from your unlawful use of the Services or your material violation of these Terms.


22. Changes to Services and Terms

TTKom may modify its Services, packages, prices, technical specifications, policies, or these Terms from time to time.

Where required, customers will be notified of material changes through appropriate communication channels.

Continued use of the Services after the effective date of updated Terms constitutes acceptance of the revised Terms, subject to applicable law.


23. Complaints and Dispute Resolution

Customers who have a complaint regarding TTKom Services should first contact TTKom through its official customer support channels.

TTKom will make reasonable efforts to investigate and resolve complaints promptly.

Where a dispute cannot be resolved through the customer-support process, the parties may pursue any remedies available under applicable law and through the appropriate authorities or courts in Malawi.


24. Force Majeure

TTKom will not be considered in breach of these Terms where failure or delay in performing its obligations results from circumstances beyond its reasonable control.

Such circumstances may include:

25. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.


26. Entire Agreement

These Terms, together with any applicable service agreement, package description, acceptable-use policy, privacy policy, equipment agreement, and other terms expressly incorporated into the Services, constitute the agreement governing your use of TTKom Services.

Where there is a conflict between these Terms and a specific written service agreement, the specific service agreement shall prevail to the extent of the conflict.


27. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Malawi.

Any legal proceedings arising from these Terms shall be subject to the jurisdiction of the appropriate courts or legally established dispute-resolution mechanisms in Malawi, subject to applicable law.
